Can I make a claim using the debtors work address?
Yes. Speak to your local court.
Where it appears to the court that there is a good reason to authorise service at a place not otherwise permitted (ie not their residential address for an individual), the court can make an order permitting service at an alternative place.
This is relevant for the service of the claim form where the defendant does not give an address at which the defendant may be served.
Where a claimant has reason to believe that the address they have is an address at which the defendant no longer resides, the claimant must take reasonable steps to ascertain the address of the defendant's current residence or ("current address").
Where, having taken reasonable steps the claimant is unable to ascertain the defendant's current address, the claimant must consider whether there is :
- an alternative place where; or an alternative method by which, service may be effected
A claimant should make an application to the court under rule 6.15 of the Civil Procedure Rules (CPR) to be able to serve the claim at the alternative address.
You can serve a claim yourself/with a friend or use a local process server.
If you choose to serve yourself you will need to provide the Court with a Certificate of Service.
